TALLAHASSEE -- The Florida Senate Democratic leader filed federal suit Thursday to enforce Florida's primary results.
Hillary Clinton beat Barack Obama 50 to 33 percent in the January 29th election... But so far, no delegates have been assigned because the Democratic National Committee says the election was held too early.
Sen. Steven Geller of Cooper City -- also a superdelegate -- believes he has a strategy that will win in the courts.
The lawsuit outlines the rules which the DNC is obliged to follow, but Cooper says it did not.
The main point brought up is the fact that a Republican-controlled legislature passed the changes to move the primary date to Jan. 29.
Cooper said House and Senate Democrats filed an amendment to move the primary in compliance with the DNC's wishes and the DNC should have taken that as a sign that the Democrats had no power to change the date.
A third point in the suit contends that the DNC did not penalize Iowa and New Hampshire for moving their primaries ahead in the calendar, thus breaking the Constitution's equal protection guarantee by treating Florida differently.
