SANFORD -- Jennifer Latham, the woman accused of stealing a newborn baby from the hospital in March, was back in court Thursday.
Latham's defense attorney, Jeffery Leukel, presented three motions at the latest hearing.
Judge Debra Nelson denied two out of the three motions -- one a request for bond to be set, and the second a motion to suppress booking information as evidence.
Latham, 40, allegedly lied about her probation status and prior record when she was booked into Seminole County Jail, and now faces a felony charge.
Leukel said Latham should have been read her rights to remain silent at that time.
"They're taking a noncustodial routine booking form, and then turning around and saying, 'Now we're going to use this as a basis to charge you with a crime,'" Leukel said to the judge. "If that's true, judge, then it's logical to say that every person who comes into the jail who answers questions from people like Miss Diaz should be given Miranda warnings. If there's any chance they're going to be charged with a crime based solely on a document such as the one before the court, then they have to be given Miranda. They have to understand that what they say could lead them to be charged."
The third motion was to suppress medical information the state has on Latham.
The judge gave the defense 10 days to file a motion to seal those medical records.
Latham's trial is set to begin Aug. 11.
